From 2009 to 2018，Anthony Carty consulted a large number of national archives from the UK, France and the US over issues of sovereignty of the South China Sea islands since the 19th century. Carty said, "China has indisputable sovereignty over the islands in the South China Sea. "

Hello Pr. Carty.What are some of the key archives that support China’s sovereignty over the South China Sea islands?

There are two outstanding documents .

在我多年研究（南海）的復雜過程中,有兩份突出的文件。

The first is a legal memorandum written by an English foreign office legal adviser in 1974. The Nansha islands for the Chinese were legally Chinese territory.

第一份是由英國外交部法律顧問于1974年撰寫的法律備忘錄。南沙群島是中國的合法領土。

Jules Basdevant who was the jurisconsult of the French Foreign Ministry. He advised that the Xisha islands belonged to China.

（另一份來自）法國外交部的法律顧問尤里斯·巴徳萬。他提出，西沙群島屬于中國。

But the governments of these countries take a supposedly “neutral”public stance. I think this is inconsistent with their own professional historical record. They are supporting geopolitically the United States in its strategy.

但（現在英法）這些國家的政府采取了一種所謂“中立”的公開立場。我認為這與他們自己的歷史記錄不符。他們（是要）在地緣政治上支持美國的戰略。

For the Americans, what matters is containing China.

What are some of the key archives that document the history of Western occupation of the South China Sea islands？

哪些文件記錄了西方列強對南海諸島的侵占？

【卡蒂教授】

At the beginning of the 1930s, Japanese activity in the area, and also there was pressure from French into China to try to expand their influence in the South China Sea.

在20世紀30年代初，日本開始在這一區域（南海諸島）開展活動。法國也向中國施加壓力，試圖擴大他們在中國南海的影響力。

After the Second World War, the Japanese were withdrawing from the islands. The Americans came into the picture.

二戰結束后，日本人從這些島嶼撤離。美國人又參與了進來。

In 1956, the American Undersecretary of State Murphy convened the meeting. Murphy said that it could be of strategic interest to the United States to encourage the Philippines to make a claim.

1956年，時任美國副國務卿墨菲召開了一場會議。墨菲說，美國鼓動菲律賓聲稱（對南沙群島擁有主權），符合美國的戰略利益。

Professor Carty summarized the Western "modes of territorial acquisition" .

卡蒂教授總結了西方的“領土獲取模式”。

The European imperialist countries seized and occupied land and then made a formal announcement: they have sovereignty over this land. This meant that the ownership of a piece of land depended entirely on who was the first to invade and establish colonial rule.

歐洲帝國主義國家攫取并占領土地，然后正式宣布：我們對這片土地擁有主權。西方的“領土獲取模式”意味著，一塊土地的所有權完全取決于誰最先入侵并建立殖民統治。

The western view of international law “territory” is nonsense. This is purely a product of imperialism. It is not the basis for having an international order ，that basis should be the self determination of peoples in respect of their homelands.

西方國際法里的“領土觀”是一派胡言。它純粹是帝國主義的產物。這不是建立國際秩序的基礎，（真正的）基礎應該是各國人民對自己家園的自決。

This should be China's position that it is legally entitled to the South China Sea islands. That the arbitration of 2016 is part of a NATO strategy to contain China.

中國的立場必須是對南海諸島擁有主權。2016年的仲裁是北約推行遏制中國戰略的一部分。

On 12 July 2016, the Arbitral Tribunal in the South China Sea arbitration established at the unilateral request of the Philippines rendered the award. The Ministry of Foreign Affairs of China solemnly declares that the award is null and void and has no binding force. China neither accepts nor recognizes it.

2016年7月12日，應菲律賓單方面請求設立的南海仲裁案仲裁庭作出裁決。中國外交部嚴正聲明，該裁決無效，不具有約束力。中國既不接受，也不承認。

I have really wandered into this subject from the time I went to Hong Kong in 2009 as a Sir Y K Pao Chair of Law in the Hong Kong University.

（I was） growing up in the north of Ireland. Ireland was actually deliberately colonized as part of the English, from the middle of the 16th century onwards, that fundamentally shapes my whole attitude. I do recognize the patterns of behavior that led to the bullying of China in the 19th century. I see the China question in terms of the leftovers from imperialism.

（我在）北愛爾蘭長大。16世紀中葉起，愛爾蘭實際上被蓄意殖民，成為英國的一部分。這從根本上塑造了我（對殖民主義）的態度。我看清楚了19世紀帝國主義欺凌中國的行為模式。我本能地從帝國主義殘余的角度，看待中國（南海）問題.
